1. Agreement and Eligibility
These Terms govern your use of VaporChart. By using the app, you agree to these Terms. Clinical use is limited to qualified healthcare professionals and personnel authorized to document the care at issue. App evaluation and training are permitted without clinical credentials when using fictional information only; do not enter real patient information for those purposes.
2. Documentation Aid Only
VaporChart is a documentation aid. It does not diagnose, recommend treatment, monitor a patient, replace clinical judgment, or guarantee that a record is complete or accurate. It must not be used as the sole record of anesthetic care unless your organization has independently determined that the resulting workflow satisfies all clinical, legal, and record-retention requirements.
3. User Verification
You are responsible for reviewing all chart content before relying on, exporting, or signing it. Values proposed by optional photo extraction can be incomplete or wrong. You must compare every proposed value with the source monitor and correct it before adding it to the chart.
4. Optional Cloud Extraction
The App Store candidate uses manual vital-sign entry and disables monitor-photo extraction. Cloud extraction is unavailable unless a deploying administrator separately configures an endpoint and enables the feature. When enabled, a photo is transmitted only after a user explicitly authorizes the upload in the extraction session. The app does not guarantee that photos are cropped, redacted, free of identifiers, or retained for any particular period by an external processor.
Do not submit protected health information to an external service unless your organization has approved the workflow, completed its security and privacy review, and put all required agreements and eligible service configurations in place.
5. Local Data and Exports
Chart records are stored in the app's local storage. You are responsible for device security, access control, backups, deletion, recovery, and exporting records to an authorized medical record system or destination. Review the Privacy Policy for more detail.
6. Acceptable Use
You may not misuse VaporChart, attempt to bypass its security controls, interfere with its services, use it unlawfully, or submit content you are not authorized to process. You may not treat an app or network availability indicator as a patient-monitoring alarm or emergency notification.
7. Availability and Changes
Features may change, be suspended, or be unavailable. In particular, optional cloud extraction depends on a separately operated endpoint, network access, service eligibility, and administrator configuration. Maintain a clinically appropriate fallback documentation workflow.
8. No Warranty
To the extent permitted by law, VaporChart is provided “as is” and “as available,” without warranties of accuracy, completeness, uninterrupted operation, fitness for a particular purpose, or regulatory suitability. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
9. Limitation of Liability
To the extent permitted by law, VaporChart's providers will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, loss of revenue, or clinical or documentation decisions made using the app. Nothing in these Terms excludes liability that cannot legally be excluded.
10. Your Organization's Terms
Your employer, facility, or deploying organization may impose additional policies. If those policies conflict with these Terms or the app's capabilities, stop using the affected workflow and contact the organization responsible for the deployment.
11. Changes to These Terms
We may update these Terms. The effective date above will change when we do. Continuing to use VaporChart after an update means you accept the revised Terms.
